Terms and Conditions
Definitions
The 'Company' or 'Orchard' shall mean Orchard Drawing Boards Limited. 'Goods' shall mean the Products, Articles, Materials, Packaging, Components and Sercives supplied or otherwise dealt in the Company. The customer shall mean the company, organisation, individual who places the order with Orchard.
Terms & Conditions of Sale
The following terms and conditions apply to all transactions with Orchard. The placement of an order indicates the customer's acceptance of these terms and conditions. Please read them carefully and print a copy for future reference.
These terms and conditions do not affect the customers statutory rights. We will treat each order for goods as an offer by the customer to purchase the goods subject to these terms and conditions.
If the goods are delivered to a third party, it is the responsibility of the customer to make any such party aware of any relevant terms and conditions.
Settlement Terms
We will issue an invoice once we have dispatched the goods to the customer unless an invoice is specifically requested for an earlier date.
Payment shall be made within 30 days of delivery of the goods and the Company shall have the right to cancel or suspend any further orders for Goods in the event that earlier invoices are overdue at the time a further order is received or due to be dispatched.
After the expiration of 30 days of delivery of the goods the Company shall be entitled to charge interest on the outstanding balance at the rate of 2% per day from that date until the date of settlement.
Any complaints as to the condition or quality relating to part of an order will not effect the liability of the customer to make payment within the stipulated time in respect of the remainder of the consignment.
Quotations & Published Prices
Any quotation or published price is subject to alteration or withdrawal without prior notice as a result of fluctuations in exchange rates or labour, materials, transport or other costs, so that the Company has the right to adjust its prices to those prevailing at the time of dispatch.
The total price payable for the goods will be stipulated on the customer confirmation of order. We are entitled to make adjustments to the price to take account of any increase in our supplier's prices, or the imposition of any taxes or duties, or if due to an error or omission the price published for the goods is wrong whether or not the order has been confirmed. We will inform the customer of the correct price and give the customer the opportunity to cancel the order. All prices are ex works and are subject to our published delivery charges and are subject to VAT at the standard rate. All charges will be shown on the order confirmation
Colour Representation
We cannot guarantee that the appearance or colours of goods shown on this site or in the company's literature exactly reproduces the appearance and or colours of the goods themselves, this can vary according to the printing methods used and the resolution of computer screens
Delivery
We will only deliver goods to the address on the order and goods will not be left without a signature. Once we have delivered the goods and a signature obtained the customer is responsible for them and any loss or damage to the goods shall be at the customer's own risk.
Any transit damage to the goods, shortages or incorrect goods supplied must be noted on the delivery consignment note at the time of delivery.
We will always endeavour to deliver goods within the times stated, but goods are subject to availability of raw materials and delay in delivery of goods is sometimes outside of our control. In addition, the delivery times may be extended due to public holidays or shutdowns for example manufacturers in Italy (Tecnostyl) close for their August holidays. Any dates specified for the delivery of the goods are approximate and we shall not be liable for any losses, costs, damages, charges, or expenses caused by any delay for delivery of the goods. For delays of more than 14 days, the customer will have the right to cancel the order and we will refund any money paid by the customer for the goods.
Cancellation of Orders
Any order cancellations must be made in writing including fax or email (a telephone call is not accepted) prior to the goods been dispatched. Orders for non-stock products including RAL colours once acknowledged by Orchard cannot be cancelled.
Notification of Claims
If goods or packaging arrive in a damaged condition a note must be made on the carrier's delivery consignment note. It is the customer's responsibility to ensure they sign for the correct number of packages as shown on the carrier's consignment note. Any damaged goods, shortages or incorrect goods must be notified to the company within 5 working days from delivery. We will not accept liability for goods lost in transit unless these conditions are met.
If in the unlikely event that goods are delivered damaged or otherwise visibly faulty, please ensure that the customer retains all the original packaging. If goods returned under this clause are found to be perfect and in full working order, these will be returned to the customer and an administration/restocking fee of 35% of the price of the goods along with the cost of carriage will be charged.
Returns and Refunds
Apart from damaged goods referred to in 'Notification of Claims' above, no goods may be returned without prior written agreement from Orchard and any returns must be notified in writing by the customer within 5 working days from the date of delivery stating the reason for the return. It is the customer's responsibility to return any goods in a pristine saleable condition and in their original box and packaging. The customer will be totally responsible for the return of the goods and any costs of return will be the customer's responsibility, including taking adequate insurance on the goods should they be damaged in transit. Goods received back incomplete, damaged or in any condition other than saleable, will be returned to the customer and the cost of return carriage charged. The Company reserves the right to impose a cancellation of 15% on any order cancelled.
No refunds will be considered if already installed unless proven to be faulty.
Availability of Goods
All products are subject to availability and may be withdrawn at any time. If the goods are not supplied for any reason we will not charge for these and we will refund any money already paid for them. However, we will not be responsible for compensating the customer for any other losses the customer may suffer if we do not supply the goods.
General
Title will not be passed and all property legal and equitable in the Goods shall remain in the Company until payment is received in full
Failure by us to enforce any of these terms and conditions will not affect our right to enforce the rest of these terms and conditions.
These terms and conditions are subject to change at any time without prior notice to the customer.
Any advice or recommendation given by us or our employees or agents to the customer or the customer employees or agents and not confirmed in writing by us as to storage, application or use of the good is acted upon entirely at the customer own risk, and accordingly we shall not be liable for any such advice or recommendation which is not confirmed.
Notwithstanding anything contained in these Terms and Conditions no liability for death or personal injury cased by negligence of the Company or its employees is excluded or limited in any way whatsoever.
We will not be liable in contract, tort, or for pre-contract or other representations (other than fraudulent misrepresentations) or otherwise for any economic losses (including without limitation loss of revenues, profits, contracts, business or anticipated savings), nor any loss of goodwill or reputation.
Jurisdiction
These conditions shall be governed by and construed in accordance with the laws of England and the customer irrevocably submits to the exclusive jurisdiction of the courts of England.

Our privacy policy should be read in conjunction with our Terms and Conditions.
Orchard gathers information from users of this web site automatically and when information is provided to use using our electronic forms. We also monitor this site's access log information and the connection address from the Internet address is automatically included within that.
Orchard takes customer privacy seriously and will not sell, trade or rent the customer personal information to any third parties.
